Marketing information

Your marketing preferences, consent records, newsletter interactions and whether you opened or interacted with a marketing communication.

Technical and website information

Your IP address, approximate location, browser, device, operating system, cookie identifiers, pages viewed, links selected, referring website, search terms, website activity, checkout activity and information about errors or security events.

Health and other sensitive information

You may choose to provide information about your health, symptoms, medications, pregnancy, allergies, or medical conditions when asking us about a product, reporting an adverse event, or using a consultation, questionnaire, or review facility.

Please provide only the health information necessary for your enquiry. We do not require medical information to complete an ordinary product order.

Purchase or browsing information may indicate an interest in a particular health condition. We treat this information carefully and do not use health information for direct marketing without the necessary explicit consent.

3. How We Collect Information

We collect information:

  • directly from you when you place an order, create an account, subscribe, contact us or complete a form;

  • automatically through Shopify, cookies, pixels, tags and similar technologies;

  • from payment providers, fulfilment partners and delivery companies;

  • from marketing, analytics, fraud-prevention and security providers;

  • from social-media platforms when you interact with our pages or advertisements; and

  • from another person who places an order for you, where appropriate.

If you provide personal information about another person, you must have their permission.

4. How and Why We Use Your Information

Processing orders

We use your information to accept payment, fulfil orders, arrange delivery, provide tracking, manage subscriptions and process returns or refunds.

Our lawful basis is that the processing is necessary to perform our contract with you or take steps at your request before entering into a contract.

Customer service and account management

We use information to manage your account, answer questions, investigate delivery issues, provide product information and handle complaints.

Our lawful basis is performance of our contract and our legitimate interests in providing effective customer service and operating our business.

Legal, tax and regulatory requirements

We use and retain information where necessary to maintain accounting records, comply with tax requirements, respond to regulators, prevent unlawful activity, establish or defend legal claims, and meet product safety or medical device obligations.

Our lawful basis is compliance with legal obligations and, where applicable, our legitimate interests in protecting our business and customers.

Product-safety and adverse-event reports

If you report a product reaction, safety concern, quality complaint or adverse event, we may record and share relevant information with manufacturers, regulatory consultants, insurers, competent authorities or other organisations involved in product safety.

Where this includes health information, we process it under an appropriate UK GDPR Article 6 basis and Article 9 condition, including compliance with legal obligations, reasons of public interest in public health, legal claims or your explicit consent, as applicable.

Marketing

We may send marketing by email, postal address or text where:

  • You have given consent; or

  • The law permits us to contact an existing customer about our similar products, and we gave that customer the opportunity to opt out when their details were collected.

You can unsubscribe at any time by selecting the unsubscribe link in an email or contacting us. We may retain limited information on a suppression list to ensure that we respect your request.

Website analytics and improvement

We use website information to understand how visitors use our site, measure performance, identify problems and improve our content, products and customer experience.

Our lawful basis is our legitimate interests in improving and securing our business. Where cookies or similar technologies require consent, processing takes place only after the necessary choice has been made.

Personalisation and advertising

With the necessary consent where required, we may use cookies and similar technologies to personalise content, measure advertising and show advertisements that may be more relevant to you.

You can change your choices through our Cookie Preferences facility and, where available, our data-sharing opt-out page.

Fraud prevention and website security

We use information to authenticate customers, secure accounts, detect suspicious transactions, prevent fraud and protect our website, customers and systems.

Our lawful basis is our legitimate interests in protecting our customers and business and, where applicable, compliance with legal obligations.

Currency and location

We may use your IP address to estimate your country and display an appropriate market, currency and shipping options. We may store your selected country or currency in a cookie or similar browser technology.

Our lawful basis is our legitimate interests in providing an appropriate shopping experience and, where relevant, taking steps to enter into or perform a contract with you.

5. Shopify

Our online store is hosted by Shopify. Shopify processes personal information when you visit the store, create an account or make a purchase.

Depending on our Shopify settings, Shopify may also process information to provide security, analytics, advertising, personalisation and other enhanced services. Some of these services use information from a customer’s interactions with Shopify and other Shopify merchants.

Where consent is required, these services will only use non-essential tracking information after you have made the relevant choice.

You can read the Shopify Consumer Privacy Policy and use the Shopify Privacy Portal to exercise certain choices relating to Shopify’s processing.

6. Who We Share Information With

Where necessary for the purposes described in this policy, we may share information with:

  • Shopify and Shopify service providers;

  • Payment providers, banks and fraud-prevention services;

  • Our authorised fulfilment centres in the United Kingdom, France and the United States;

  • Postal operators, couriers, customs agents and delivery companies;

  • Subscription and recurring-payment providers;

  • Website hosting, IT, security, customer-support and communications providers;

  • Email, SMS and marketing platforms;

  • Analytics and advertising providers, subject to applicable consent and opt-out requirements;

  • hCaptcha and other website-security providers;

  • Professional advisers, including accountants, auditors, insurers, consultants and solicitors;

  • Manufacturers, regulatory consultants and competent authorities where a product-safety report requires this;

  • Law-enforcement agencies, courts, regulators or public authorities where required or permitted by law; and

  • A prospective purchaser, investor or successor if our business or assets are reorganised, sold or transferred, subject to appropriate confidentiality and legal protections.

We require service providers acting on our behalf to protect personal information and only use it for the agreed purposes.

We do not sell personal information for money. However, some disclosures involving advertising cookies or cross-site advertising may be legally defined as “selling”, “sharing” or “targeted advertising” in certain US states. Where those laws apply, eligible customers can opt out via our contact form or Cookie Preferences.

7. International Transfers

Made By Daily operates and uses service providers in several countries, including the United Kingdom, the European Economic Area, the United States and Canada. Your information may therefore be processed outside the country in which you live.

Where data-protection law requires safeguards for an international transfer, we use an approved mechanism such as:

  • An applicable adequacy regulation or decision;

  • The UK International Data Transfer Agreement or UK Addendum;

  • European Commission Standard Contractual Clauses; or

  • Another legally permitted safeguard.

You may contact us for further information about the safeguard used for a particular transfer.

8. How Long We Keep Information

We retain information only for as long as reasonably necessary for the purpose for which it was collected, including legal, accounting, tax, regulatory, and dispute-resolution requirements.

Our normal retention periods are:

  • Order, payment, refund and accounting records: six years from the end of the relevant company financial year, or longer where legally required;

  • Customer accounts: while the account remains active, after which relevant transaction records may continue to be retained for the period above;

  • Routine customer-service enquiries: normally up to two years after the enquiry is closed;

  • Health information supplied during a general product enquiry: normally up to two years, unless it forms part of an adverse-event, safety, regulatory or legal record;

  • Product-safety and adverse-event information: for the period required by applicable product-safety, medical-device and regulatory laws;

  • Marketing information: until you unsubscribe, withdraw consent or we determine that the information is no longer required;

  • Suppression-list information: for as long as necessary to ensure we continue to honour an opt-out; and

  • Cookie and analytics information: for the periods stated in our Cookie Policy or cookie-preference facility.

We may retain information for longer if there is an unresolved complaint, legal claim, regulatory investigation or legal requirement.

9. Cookies and Similar Technologies

We use cookies and similar technologies for purposes including:

  • Operating the basket and checkout;

  • Keeping accounts secure;

  • Remembering country, currency and preferences;

  • Measuring website use and performance;

  • Preventing fraud;

  • Personalising content; and

  • Measuring and delivering advertising.

Strictly necessary cookies are used where required to provide a service you have requested.

Except where an applicable legal exemption permits otherwise, analytics, advertising and other non-essential technologies are not used until you have made the relevant choice through our cookie banner.

You can accept or reject available cookie categories and change your choices at any time through Cookie Preferences. Rejecting non-essential cookies will not prevent you from making a purchase, although some optional features may work differently.

Our separate Cookie Policy should identify the cookies and similar technologies used, their providers, purposes and durations.

10. Marketing Choices

You can stop marketing emails or messages by:

  • Selecting the unsubscribe link in the communication;

  • Changing your account preferences; or

  • Emailing hello@madebydaily.com.

Stopping marketing does not prevent us from sending service messages relating to an order, subscription, recall, safety issue or account.

11. Your Rights

Depending on your location and the processing involved, you may have the right to:

  • Request access to your personal information;

  • Request correction of inaccurate information;

  • Request deletion of information;

  • Restrict how information is used;

  • Object to processing based on legitimate interests;

  • Receive certain information in a portable format;

  • Withdraw consent at any time;

  • Object to direct marketing;

  • Opt out of certain targeted advertising, sale or sharing of personal information;

  • Request information about how your data has been disclosed; and

  • Complain to a data-protection regulator.

These rights are not absolute and may be subject to legal exceptions.

You have the right to object at any time to our use of your personal information for direct marketing.

To exercise a right, email hello@madebydaily.com with the subject “Privacy Request”. We may need to verify your identity before completing the request.

We will not discriminate against you for exercising a privacy right.

12. Privacy Complaints

To make a complaint about how we have used your personal information, email hello@madebydaily.com with the subject “Data Protection Complaint”.

We will acknowledge a data-protection complaint within 30 days and respond to it without undue delay.

UK customers can also complain to the Information Commissioner’s Office:

13. US Privacy Choices

Where an applicable US state privacy law gives you additional rights, you may request access, correction, deletion, or portability, and may opt out of a legally defined sale, sharing, targeted advertising, or certain profiling.

We recognise browser-based opt-out signals, such as Global Privacy Control, where required by applicable law.

Requests can be made by emailing hello@madebydaily.com.

14. Health Information and US Customers

Certain US state laws may treat information about health conditions, symptoms, product interests or searches relating to health as consumer health data.

If we collect consumer health data through a questionnaire, consultation, symptom tool, or similar facility, we will provide any additional health data privacy notice and consent mechanism required by applicable law.

We do not use voluntarily supplied health information for unrelated advertising without the permission required by law.

15. Automated Decisions

We may use automated tools to detect fraud, identify security risks, provide product recommendations or personalise website content.

We do not ordinarily make decisions based solely on automated processing that produce legal or similarly significant effects. If this changes, we will provide the information and safeguards required by applicable law.

16. Security

We use appropriate technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, alteration or disclosure.

No online system is completely secure. You should use a unique password and contact us promptly if you believe your account or information has been compromised.

17. Children

Our online store is intended for adults. We do not knowingly collect personal information directly from children for marketing or account creation.

If you believe a child has provided personal information to us without appropriate permission, please contact us.

18. Third-Party Websites

Our website may contain links to websites operated by other organisations. Their privacy policies apply to information they collect directly, and we are not responsible for their privacy practices.

19. Changes to This Policy

We may update this policy when our services, technology, legal obligations or information-handling practices change.

The latest version will be posted on this page with a revised “Last updated” date. Where a change materially affects how we use your information, we will provide an additional notice where required.
